Warranty Period & Scope

Subject to the terms and conditions further defined herein, Toothbox® warranties each product to be free from defects in material and craftsmanship on the terms and conditions set out herein. All Products are fabricated using materials traceable to the source. If the products have defects in materials or craftsmanship within the Warranty Periods, then we will, at our discretion, repair the defect, replace the product, or refund the original amount paid, subject to the Eligibility and Claims Procedures stated herein these Warranties.

Eligibility and Claim Procedure

These Warranties are contingent on the following conditions:
Toothbox® supplied Products only.

• Warranties herein are only eligible to direct customers, and not where Products have been resold.
• All indications/contraindications of Products observed.
• All Products used in accordance with suggested guidelines and/ or instructions, as well as generally accepted uses for the Products.
• Proper maintenance, sanitization, and sterilization by user.
• All claims under these Warranties must be made within 30 days from the date of delivery and must be accompanied with the written cause of the claim, your name, and the date of the sale.
• Product being claimed under Warranty for replacement or a refund (and any components thereof) must be returned for inspection in order to be eligible for any Warranty.
• Where Product being claimed is no longer a Toothbox® manufactured Product, Toothbox® may, at its discretion, repair or replace with new model or new components, as the case may require. Upgrade Fees may apply.
• We reserve the right to disallow a claim under these Warranties if payment for the Product has not been made.

Warranty Exclusions

• The remedies provided herein are the purchaser’s sole and exclusive remedies, and are not transferable.
• Cost incurred for return shipping are not covered.
• We do not give cash refunds.
• The amount of any refund is limited to the amount of the original invoice.
• No alterations or changes to the original Product sold.
• Only one repair or replacement per Product.
• These Warranties do not apply where there is breakage due to accident, neglect, or misuse.
• These Warranties do not apply to any Product that has been, altered, repaired, or misused in any way that, in the opinion of Toothbox®, affects the reliability or detracts from the performance of the Products.

Shipping

We do not guarantee the performance of independent carriers.

Modification or Withdrawal of Warranties

These Warranties are effective as of April 15, 2020. These Warranties may not be modified by any agent, employee or representative of Toothbox®, and we reserve the right to modify or withdraw these Warranties at any time without notice. Modification or withdrawal will not affect warranty benefits for Products sold prior to the effective date of the modification or withdrawal.

General Limitations on the Warranties

These remedies are exhaustive of all other remedies. Excepting the terms and conditions set out Herein, neither Toothbox®, nor any of its agents, representatives, subsidiaries, or Affiliates, make any other representations, warranties, or covenants, or other undertaking, either Express or implied, written or oral, including without limitation any implied warranties as to Durability, fitness for a particular use or purpose, suitability or functionality. Furthermore, except where prohibited by law, Toothbox®, its agents, representatives, and Affiliates, independently and collectively disclaim any and all liability regarding any direct or Indirect, incidental, consequential, punitive, liquidated or special damages, whether based on Contract, tort, or any other legal theory, resulting or arising from either the manufacture, Constitution, infringement, design, use, including those of merchantability and fitness for a Particular purpose or function. Products may not be suitable for everyone, in particular those with Certain medical conditions.
Customers are advised to rely exclusively upon their own skill and judgement before purchasing.
